(Superior Court Case No. LC100323).

THE LAWSUIT'S ALLEGATIONS

According to the Mandegar v. Auto Net lawsuit's Second Amended Complaint (which the Plaintiff filed in November 2013), the consumer Plaintiff visited Auto Net at its Woodland Hills used car lot earlier this year after viewing the dealership's advertisements for a used 2009 BMW. The Complaint goes on to allege that Auto Net represented that the BMW had been inspected and was in immaculate condition, but that after the Plaintiff purchased the automobile she found out that it had actually been in a serious prior accident in which it suffered frame damage.

Other significant allegations in the Complaint include the Plaintiff's claim that Auto Net has an illegal practice of obtaining is customers' signatures on partially-blank "Statement of Facts" forms, and then filling them in later to create the false appearance that the dealership disclosed all of its used automobiles' problems and defects to their purchasers.

For its part, Auto Net has asserted in the lawsuit that it has no illegal practice, that it properly disclosed the BMW's accident damage to the Plaintiff, and that she signed a Statement of Facts form acknowledging the existence of the prior accident damage.
