New IP Litigation Boutique, Kroub, Silbersher & Kolmykov PLLC, Opens in New York

A newly formed law firm, Kroub, Silbersher & Kolmykov PLLC, provides quality intellectual property litigation and counseling services, while offering cost savings to its clients through a flat and other flexible monthly fee arrangements.

A new high-end intellectual property boutique law firm, Kroub, Silbersher & Kolmykov PLLC, launched operations today. Located in New York City, and founded by Gaston Kroub, Zachary Silbersher and Sergey Kolmykov, the firm will focus on providing quality patent and other intellectual property litigation and counseling services, while offering a unique and flexible fee structure.

Messrs. Kroub, Silbersher and Kolmykov are launching the new firm after practicing together in the intellectual property department of the New York office of a highly regarded international law firm. They intend to fill a growing demand in the market from both patent-holders and accused infringers for smart, effective legal representation at predictable costs and with attentive service.

According to Mr. Silbersher, "Flexible cost structure is a key ingredient to our new firm's business model, which will include flat monthly fees along with contingency and hybrid fee arrangements."

Mr. Kolmykov continued, "We've each practiced on patent litigation teams where, along with one or two other attorneys, we essentially ran the case. We realized that we can offer the same focused service, but with a lean nimble team that cuts out the make-work and unnecessary work."

"If we need to scale up or down, we can do that as the case requires," Mr. Kroub added. "Patent litigation is generally an expensive endeavor for companies, but we know from our experiences at large firms how to offer the same service at more reasonable prices."

The firm will focus on representing both patent-holders and accused infringers in litigation. On the plaintiff-side, the firm intends to leverage its deep networks within the patent-monetization community among patent-assertion entities, inventors and investors. In particular, it intends to offer customized services to inventors seeking to monetize their patents. Mr. Silbersher stated, "There is a growing chorus of inventors who do not view themselves as trolls, but rather as seeking fair compensation from larger companies that are illegally making money off their ideas. We intend to service that demand."

On the defense side, the firm brings substantial experience to the table in both competitor cases and in defending those brought by non-practicing entities (NPEs). "Many of these companies lack in-house patent counsel. They require a higher level of responsiveness and advice from their attorneys. Our business model is set up to cater to that demand," said Mr. Kolmykov.

With more than thirty years of collective experience, the members of Kroub, Silbersher & Kolmykov have acted on behalf of plaintiffs and defendants, through both trials and appeals, in patent litigations throughout the country, including extensive experience in the ITC as well as within each of the districts that see the most patent cases, including the Eastern District of Texas, the Eastern District of Virginia, the District of Delaware, the Central District of Florida and the Northern District of California, among others.

Prior to founding, Kroub, Silbersher & Kolmykov PLLC, Gaston Kroub was a partner at a highly-regarded international law firm in New York, which he joined in 2011 after nearly a decade in the New York office of another leading international law firm. While at his prior firms, Mr. Kroub litigated a wide variety of patent and other intellectual property cases, across a number of technical disciplines. He was recently selected for inclusion by Superlawyers Magazine's NY-Metro Edition for Intellectual Property Litigation, after previously being recognized on the list of "Rising Stars" for Intellectual Property Litigation by that same publication. A frequent speaker and author on intellectual property topics, Mr. Kroub is on the Executive Committee of the New York State Bar Association's IP Section, where he co-chairs the Greentech Committee.

Zachary Silbersher previously practiced patent litigation and prosecution at a premiere national law firm and Morgan & Finnegan LLP before that. Prior to that, he practiced general commercial and civil litigation for several years before returning to school and earning a BS in Physics from Columbia University with the intent of pursuing patent litigation. He has experience with all facets of patent litigation, patent monetization, multi-defendant case representation, re-examinations, licensing and pre-litigation counseling.

Sergey Kolmykov started his career as a patent agent in 1999 at the New York offices of premiere national law firms, including Morgan & Finnegan. With an electrical engineering degree from Cornell University, Mr. Kolmykov has represented clients in matters involving a wide variety of technologies, including wireless telecommunications, digital and analog circuits, error control coding, video and audio compression, computer software and hardware, semiconductors, internet applications, networking, e-commerce and financial systems. Mr. Kolmykov has broad experience in licensing of intellectual property and was involved in analyzing multi-party licensing agreements, and evaluating patents for inclusion in certain multi-party licensing programs, including various licensing programs for standardized technologies. As counsel, Mr. Kolmykov successfully led numerous patent litigations, both on behalf of plaintiffs and defendants in the District Courts and the International Trade Commission.
