Every state has their own debt collection laws. Think about how much you can afford and then offer even less. Don't pay or commit to pay anything you can't afford to do. Prioritize your more important bills. Providing necessities for your family comes first. Dr credit suggests that consumers always remember not to tell debt collectors their "sad story". Munce Urges debtors to save their breath. Do not go into any kind of detailed story of why you can't make this months' payment. Do not agree to automatic electronic payments from your checking account. Don't think the collector has any of your best interests in mind or you'll find yourself in world of pain.

Don't give any debt collector any personal information --not where your relatives live, not where you bank or your checking account number(s) not where you work or any other private information. no matter what the debt collectors stay unemotional and keep in negotiation. Always use tape recorder to get a record of the call. Remember you can tape record the other party's conversation, if the call is in one of many states that allow taping or if you tell them you are going to tape it and they continue the call, they just gave you a legitimate form of "permission". Take notes on everything that was said. Keep files of your collection letters and keep detailed notes of the calls. Note the day and time of everything that was said. Get proof of payment agreement in writing If they told you 50 cents on the dollar will work and that's what you want to do, get it in writing. Send a certified or registered letter to the debt collector outlining the payment agreement. You'll want to send this letter via certified mail so you'll receive a receipt once the letter is delivered. Keep a copy for your records. Write on the back of your payment check, that cashing this check constitutes all payment in full. Ask the debt collector to remove any and all derogatory information they've placed on your credit report. Always get it in writing that your account is reported as paid as agreed. If you can't get them to do that then ask for "paid in full" (rather than paid in settlement).
Collectors always create urgency and intend to push you to send them money immediately.

Dr Credit advises, don't send any money until you have confirmation of a payment agreement in writing.
