Oceanside, California Attorney Sues Toyota in Lemon Law Lawsuit


Prominent Southern California consumer rights attorney files another lemon law lawsuit against Toyota Motor Sales, U.S.A. alleging that Toyota was unable to repair the steering and braking defects in a 2012 Toyota Corolla automobile.

Oceanside, California (I-Newswire) July 9, 2012 - Prominent Southern California lemon law attorney Michael R. Vachon, Esq. has announced the filing of another defective automobile lawsuit. The lawsuit, Ramirez v. Toyota Motor Sales, U.S.A., Inc., et al, was filed in California's San Diego County Superior Court on June 19, 2012 (Case No. 37-2012-00054566). It is the latest in a string of defective vehicle lawsuits that the Law Office of Michael R. Vachon, Esq. has filed against automobile manufacturers and Southern California dealerships this year.


COMPLAINT ALLEGES TOYOTA COROLLA SUFFERS FROM SAFETY DEFECT

The lawsuit was filed on behalf of Oceanside, California consumer Jose Ramirez, who alleges in his complaint that earlier this year he purchased a brand new 2012 Toyota Corolla from a San Diego County Toyota dealership. Thereafter, he alleges that the Corolla manifested a defect that causes its steering and braking systems to malfunction, and which resulted in the vehicle being unsafe to drive. He alleges that he took the automobile to Toyota's authorized repair facility three times for repair of the defect under the car's warranty, but that Toyota was unable to fix the problem.

The complaint alleges that Toyota violated California's lemon law by failing to repair Mr. Ramirez' automobile within a reasonable number of attempts. Mr. Ramirez is seeking a court order compelling Toyota to issue a lemon law buyback for the Toyota Corolla, to pay a civil penalty, and awarding him his attorney's fees and costs.

The San Diego County Superior Court has not yet to determine whether or not Toyota Motor Sales, U.S.A. (the company that issued the warranty for Mr. Ramirez's Toyota Corolla) violated the law or committed any wrongdoing, and Toyota is expected to deny all liability when it answers the complaint.
