California (I-Newswire) September 24, 2012 - The top-caliber employment attorneys of the Mesriani Law Group (MLG) recently secured a $65,000.00 settlement for an African-American male employee who was racially discriminated against and harassed by his former superiors.

Case files revealed that the client-employee served 14 yrs. as a quality supervisor in an undisclosed manufacturing company. His commendable work ethic, clean track record, and good performance enabled him to stay employed that long in the company. However, his time in the company took a negative turn when he was persistently discriminated against and harassed in the workplace by two of his former managers.

The first manager apparently failed to consider taking any remedial actions against employees with excessive absences or tardiness despite the client-employee presenting such evidence. Moreover, around early 2009, the said manager assigned another colleague as his personal assistant and inspector. With him at the helm, the first manager was able to avoid accountability on the client-employee’s concerns about the attendance violations of other employees.

The first manager’s personal assistant and inspector then took the lead of discriminating said client-employee, escalating it when he became a manager. In mid 2010, the client-employee was subjected to an investigation for the first time in his tenure in the company concerning his alleged romantic involvement with a female colleague.

The said accusation led them to be questioned at the human resources office. It was found out, however, that the accusation was concocted by the second manager and his group.

Additionally, the same group spread a rumor through Facebook, questioning the client-employee’s character and competence. Consequently, more than 20 employees responded to the post; with most of them commenting negatively towards the client-employee.

In February 2011, said client-employee was again discriminated against by the second manager when the same female colleague with whom he was allegedly romantically-linked with was promoted as a quality specialist, without him getting an offer for the job position despite his 14-year tenure in the company.

The discrimination inside the workplace further worsened when the second manager’s group intentionally spoke with each other in Spanish, thinking that said client-employee wouldn’t understand what they were saying. The client-employee often heard a derogatory phrase in Spanish uttered around the group whenever he was in their presence. The phrase, when translated in English, is an offensive remark directed towards him and his race.

Accordingly, the client-employee complained to his immediate superiors all the discriminatory acts that he suffered in the hands of his colleagues. However, they did not do anything to prevent or reprimand the instigators. He eventually reported the offenses to the company’s upper management and president of operations.

Unfortunately, they, too, failed to address all the derogatory comments made against him and his race, as well as the actions of his colleagues and co-workers. By exposing him in this negative manner, the company established an excuse to terminate him through constructive discharge.

As a result of his ordeal in a hostile, intimidating, and offensive work environment, the client-employee clearly suffered severe emotional distress, anxiety, and depression. He was evidently a victim of employment discrimination and harassment on the basis of his race.
