Magic Auto Center, the popular Panorama City, California used car dealership has been named as a defendant in a lawsuit alleging that it sells accident-damaged used automobiles without disclosing the known damage. The lawsuit was filed in the Los Angeles County Superior Court on March 14, 2013. Magic Auto Center, et al. (Docket No. LC100049).

ALLEGATION AGAINST MAGIC AUTO CENTER

(Note: the court has not ruled on whether or not the allegations in the Plaintiff's complaint are true and Magic Auto Center is expected to deny all wrongdoing when it answers in the lawsuit).

According to the lawsuit's complaint, in September, 2012 Plaintiff Sandra Gonzalez visited Magic Auto Center's dealership lot, and while there was shown a used Lexus GS300. Gonzalez claims that Magic Auto Center told her that the vehicle had been thoroughly inspected and was in excellent condition. Her complaint goes on to allege that she relied on Magic Auto Center's representations in deciding to purchase the Lexus GS300, but later found out that the dealer's statements were untrue. Specifically, Gonzalez alleges that the Lexus GS300 had been in a serious collision prior to her purchase of it, and that as a result it suffers from defects that make it unsafe to drive.

Ms. Gonzalez's attorney, Michael R. Vachon, Esq., argues in the complaint that Magic Auto Center's alleged conduct violates the California lemon law statute, amounts to fraud, and violates other California consumer protection statutes.
