A New Jersey man will spend three years in jail because he went deer hunting with a rifle which he should not have used because he had a prior criminal record.

Kenneth Arnold is a 37-year-old former heroin addict who at age 18 spent some time in jail on burglary convictions. Under New Jersey law, he is prohibited from using or possessing weapons at anytime because of his criminal history. Two years ago, Arnold went hunting on private property with a deer license purchased from a local store and a borrowed rifle. He shot a deer, checked it in with the state deer check station and that station later determined that he was not eligible to use or possess a gun. Eventually an indictment was filed against him. Local Prosecutors who filed the charges against him agreed that the three-year sentence is too harsh but claim that they are prohibited from doing anything else because of state law. New Jersey State law states that anyone who is convicted of a gun crime who has a prior criminal record is ineligible for parole.
