Cancelling the contract with Express Home Services, LLC. based on their failure to meet contract requirements of providing quality flooring and installation and failing to have installers show up for a scheduled install date on file to attempt to repair the work.
It isn't just the vinyl that is not acceptable and installed poorly, they installers have caused excessive damage to baseboards, walls, tub that are beyond what is considered reasonable for the work performed. It also says in the contract "installers will correct problems before leaving" and problems were brought up before Installers left and they left an unfinished job without attempting to resolve the problem on Tuesday 9/25/2012.
At this point a dispute has been filed with GE Capital Retail Bank in regards to this transaction and they are now the ones who will handle the dispute at this point since they are the financier of the transaction.
Uninstalled/non-damaged material can be collected.
ROC complaint has been filed against Benny Lopez Carpets, LLC
3TV 3 On Your Side, Channel 12, Channel 15, AZ Attorney general,Federal Trade Commission, and Sheriff's dept have been contacted regarding the situation.
The only satisfactory resolution at this point is for Express Home Flooring, LLC. to void the contract and contact GE Capital.
Reviews of the business practices have been added to Yelp, Google Local and will soon be added to RipOffReport and every other media/consumer report outlet if this situation is not corrected by Express.
Will also be contacting Gerald Lederer, Bradford Beck and Brandon Lederer regarding this matter, the listed owners of Express Home Services, LLC.
In light of new information discovered it was best to seek out legal counsel for the best course of action based on this information and everything leading up to this point, with the conclusion being that it was requested that Express Home Services, LLC. rescind the contract and refund GE Capital the $6,689.26 balance.
Received no benefit from this contract and the denial of the same installation contractors to come back on site is based on anticipatory repudiation.
A licensed contractor to inspect and install flooring and what was found is that there was black glue from old tile covering the sub floor. ROC guidelines state that the flooring installer must take responsibility for the floor condition prior to installation and this was not done. There was no licensed ROC contractor on site to inspect the sub flooring, instead 2 people were sent out and attempted to install Vinyl over a subflooring that was improperly prepped and there was no possibility the adhesive or vinyl flooring would have bonded with the black glue on the sub flooring. Because Benny Lopez who is the ROC licensed contractor was not onsite to oversee the operation, and did not inspect the sub-flooring and is not in compliance with ROC guidelines, it is only after a complaint was filed that pictures were taken, but since the vinyl was already laid down no one would have been able to see and inspect the sub flooring.
As mentioned above, the installation was incomplete and so poorly done that it didn't require a licensed flooring contractor to notice, so the reasons for not allowing the same workers on site were based on anticipatory repudiation knowing full well there was no chance of repairing the existing flooring. The installation crew Express Flooring sent on site damaged the materials and product as part of the installation, there was no benefit provided whatsoever by Express Home Services, LLC. and the vinyl has since had to be removed and another licensed and bonded contractor hired to prepare the sub-flooring and install new flooring.
As GE Capital notes the company, Express already been paid for the contract, there were no services rendered, no benefit provided and the contract needs to be rescinded with monies returned to GE Capital.
Previous to written communications to come to terms this week, The Attorney General has been contacted and filed an ROC complaint against Benny Lopez Carpets, LLC for the work performed. If Express Home Services, LLC rescinds the contract and refunds the full price of $6,689.26 to GE Capital then all further complaints would stop and News Outlets, Attorney General and will not file any further complaints against Express Flooring / Express Home Services, LLC since the right thing is to rescinded the contract.
Express has picked up all of the materials belonging to Express.
These events are unfortunate and are a result of the sub-contractors who were hired by Express to perform the work,
This company is a fraud and takes advantage of the customers. Mr. Jaffe is more concerned about being bullheaded and playing games than actually running a reputable business. Arizona residence beware.......
