Classic Chariots Sued For Allegedly Pawning Off Accident-Damaged Automobiles


Southern California Lemon law lawyer files another lawsuit against Classic Chariots alleging that the Vista, California used car dealership fails to disclose known accident damage sustained by vehicles that it sells.

San Diego, California (I-Newswire) August 16, 2012 - The popular Vista, California used car dealership "Classic Chariots" is being sued by a prominent Southern California lemon law lawyer in a lawsuit alleging that the dealership has an illegal practice of selling accident-damaged vehicles without disclosing the damage to the buyers. The case was filed in the San Diego County Superior Court on August 9, 2012, and is titled Cruz et al. v. Classic Chariots, Inc., et al. (Case No. 37-2012-00056167).

ALLEGATIONS LEVELED AGAINST CLASSIC CHARIOTS

The Plaintiffs in the Cruz v. Classic Chariots lawsuit are Lazaro and Paulina Cruz, a Carlsbad, California couple who are being represented by prolific San Diego County lemon law attorney Michael R. Vachon, Esq. According to the complaint filed by Mr. & Mrs. Cruz's attorney, the Plaintiffs visited Classic Chariots at its Vista, California dealership lot in February of 2011. While there they looked at and eventually purchased a 2010 Nissan Versa that Classic Chariots had previously advertised to be "better than certified." Further, Mr. & Mrs. Cruz allege the Classic Chariots salesperson who helped them told them that the Nissan Versa had been thoroughly inspected, and was in excellent condition.

According to the complaint, after Mr. & Mrs. Cruz bought the Nissan Versa they discovered that – contrary to Classic Chariots's representations – the automobile had previously been in a major accident in which it suffered frame damage. The complaint filed by Mr. & Mrs. Cruz's lemon law lawyer alleges that Classic Chariots violated numerous California consumer protection statutes by not disclosing the accident damage. Specifically, the complaint alleges that Classic Chariots violated California's Consumers Legal Remedies Act, the Song-Beverly Consumer Warranty Act (frequently called the "California lemon law"), and the Unfair Competition Law. The complaint also alleges that Classic Chariots committed common law fraud.

Probably the most notable allegation in the complaint filed by Mr. & Mrs. Cruz's lemon law attorney (who is known for taking aggressive positions in consumer protection lawsuits) is the claim that Classic Chariots has an illegal business practice of selling accident-damaged cars without disclosing the known damage.

Note: the court has not yet made any rulings in the Cruz v. Classic Chariots lawsuit. Classic Chariots is expected to deny all of the allegations in the complaint when it responds in court.
